Surjit Dubb

Surjit joined Hempsons in January 2020 as part of our merger with Eastwoods. He is ranked in both Chambers & Partners UK and Legal 500 for professional discipline and crime.

Surjit’s work portfolio covers a wide range of healthcare regulatory, crime and disciplinary work, including: clinical negligence claims; inquests; NHSE investigations; but with a particular emphasis on crime in regard to sexual allegations and matters relating to fraud.  Surjit is also instructed by the Police Federation of England and Wales to represent police officers in both criminal and misconduct/disciplinary proceedings.

In recent years Surjit has represented a number of professionals in the defence of criminal allegations including serious sexual offences, fraud and assault of patients.

Criminal Defence

Surjit has extensive experience in representing clients facing criminal proceedings, particularly doctors and other healthcare professionals facing allegations including serious sexual offences; gross negligence manslaughter; NHS counter-fraud and investigations by the Medicines and Healthcare products Regulatory Agency (MHRA). Surjit frequently attends police interviews and he has successfully defended clients in both magistrates court and crown court trials. Over the years, Surjit has achieved particular success in defending serious sexual offences, many of which have been high profile and have attracted considerable press interest from the outset.

Regulatory Defence

Surjit is known for his professional discipline expertise, having represented professionals in regulatory and disciplinary matters at the Medical Practitioners Tribunal Service (MPTS) / General Medical Council, General Dental Council, Care Quality Commission, Royal Pharmaceutical Society and NHS Trust Disciplinary matters. Surjit appears before the Interim Orders Tribunal at the MPTS on a regular basis. Surjit has also represented doctors at internal disciplinary proceedings and appeals to the first tier and upper tribunals. 

Police

Surjit defends individual police officers facing regulatory and criminal allegations.  This includes attending interviews under caution with the IOPC and assisting at all stages of gross misconduct and criminal proceedings.  Whilst at Eastwoods, Surjit Dubb and Adam Smith secured a place for the firm on the Police Federation’s panel of solicitors, and this continues at Hempsons, with Surjit regularly assisting Federation members.

Clinical Negligence

Surjit has defended medical and dental professionals in clinical negligence claims throughout his career. This has covered a wide range of matters, including catastrophic brain injuries, cancer misdiagnosis and cases involving injuries as a result of negligent orthopaedic surgery.

Inquests

Surjit has represented several clients at inquests over the years. Notable cases include representing a doctor at a four-week inquest into the death of a young woman who died of methadone toxicity whilst in police custody.

Judicial Review/Appeals

Surjit has considerable experience of assisting clients with statutory appeals and judicial review claims against decisions of regulatory bodies, with particular expertise in advising clients on appeal following crown court trials.
