GP Successful in Appeal Before First Tier Tribunal
Surjit Dubb (instructing Andrew Hockton of Serjeants’ Inn Chambers) successfully advised and represented an Appellant GP before the First Tier Tribunal. The GP appealed a decision of a Performers List Decision Panel (PLDP) of NHS England to remove him from the NHS Performers List.
The appeal, which took place at the Royal Courts of Justice, centred around allegations made by two former male patients of the GP that they were sexually assaulted during clinical examinations. In 2017 the PLDP had determined to remove the GP from the NHS Performers List on the ground of unsuitability. Eastwoods lodged an appeal with the First Tier Tribunal.
The Appeal hearing took place in February 2018. After hearing evidence from the two male complainants, NHS England witnesses, the GP concerned and an expert instructed on behalf of the GP, the First Tier Tribunal reserved its decision, which was published on 11 April 2018 and allowed the appeal.
