Paediatrician Successfully Appeals Immediate Order of Suspension Imposed by the Medical Practitioners Tribunal Service

Surjit Dubb  (instructing Andrew Hockton of Serjeants’ Inn Chambers) successfully advised and represented a paediatrician with her appeal against an immediate order of suspension imposed by a Medical Practitioners Tribunal of the MPTS.

Eastwoods’ client had appeared before the Tribunal in relation to allegations concerning her fitness to practise. The Tribunal had determined to impose an immediate order of suspension on her registration. Eastwoods lodged an appeal in the Administrative Court in Manchester, pursuant to Section 38 of the Medical Act 1983 (as amended).

After hearing submissions from counsel for both the doctor and General Medical Council (GMC), Mr Justice Lane ordered that the immediate suspension be terminated subject to undertakings given to the Court on behalf of the doctor.

It is hoped the judgment will assist practitioners across a range of specialties in considering whether or not to appeal an order of immediate suspension imposed by their regulator.
