Deep understanding of the regulatory environment
We have worked for many years with both regulatory bodies and providers of social care, for example care home operators. We have secured a place on the panel of legal advisers to the Care Quality Commission (CQC). Hempsons regularly advise on all aspects of social care law including the Care Standards Act 2000 and associated regulations. We have acted in a number of cases pursued through the First Tier Tribunal, Health, Education and Social Care Chamber (formerly the Care Standards Tribunal) concerning the cancellation of registration, disputes over conditions of registration and in relation to the de-registration of Homes for the Learning Disabled.
Our aim is to provide responsive and proactive advice so as to manage cases in a cost effective and efficient manner, seeking early resolution wherever possible.
In addition to work in the tribunal, we have experience of advising in relation to prosecutions and have acted for the Commission for Social Care Inspection (predecessor body to the CQC) pursuing successful prosecutions for breach of regulations on their behalf.
